Please read these Terms of Service ("Terms") carefully before using bridgestats.com (the "Service"), operated by BridgeStats ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

1. Acceptance of Terms

By accessing, browsing, or using BridgeStats, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

We reserve the right to modify these Terms at any time. Material changes will be indicated by updating the "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the revised Terms.

2. Description of Service

BridgeStats is a public infrastructure data platform that aggregates, analyzes, and presents bridge and dam condition data sourced from publicly available U.S. federal government databases, primarily:

  • National Bridge Inventory (NBI): Maintained by the Federal Highway Administration (FHWA), containing inspection data for over 620,000 bridges.
  • National Inventory of Dams (NID): Maintained by the U.S. Army Corps of Engineers, containing data on dams across the United States.

The Service provides search, analysis, visualization, comparison, and reporting tools to make this public data accessible and understandable. We also offer premium subscription plans with enhanced features and capabilities.

3. User Accounts

3.1 Account Creation

You may create an account using Google OAuth authentication. By creating an account, you agree to provide accurate, current, and complete information. You are responsible for maintaining the security of your Google account credentials and for all activity that occurs under your BridgeStats account.

3.2 Account Responsibilities

You agree to:

  • Keep your account credentials secure and not share access with others
  • Promptly notify us of any unauthorized use of your account
  • Not create multiple accounts for deceptive purposes
  • Not use automated systems to create accounts

3.3 Account Termination

You may request deletion of your account at any time by contacting [email protected]. We reserve the right to suspend or terminate accounts that violate these Terms, with or without notice.

4. User-Generated Content

4.1 Your Content

You may submit ratings, comments, reviews, and other content ("User Content") through the Service. You retain ownership of your User Content, but by posting it on BridgeStats, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, display, and perform your User Content in connection with operating and promoting the Service.

4.2 Public Visibility

Ratings, comments, and reviews you post are publicly visible and may be displayed alongside your display name and profile picture. Do not share sensitive personal information in your public contributions.

4.3 Content Standards

You agree not to post User Content that:

  • Is unlawful, defamatory, obscene, or harassing
  • Infringes on the intellectual property rights of others
  • Contains malware, spam, or unauthorized advertising
  • Impersonates another person or entity
  • Is intentionally false or misleading regarding bridge or infrastructure conditions
  • Violates any applicable law or regulation

4.4 Content Moderation

We reserve the right, but are not obligated, to remove or modify any User Content that violates these Terms or that we deem inappropriate, at our sole discretion and without prior notice.

5. Data Accuracy and Use Disclaimer

IMPORTANT NOTICE

All bridge and dam data presented on BridgeStats is sourced from public government databases and is provided strictly for informational and educational purposes only. This data:

  • Must not be used for vehicle routing, route clearance, or load capacity decisions.
  • Must not be relied upon for engineering, construction, or structural assessments.
  • Must not be used as a substitute for professional inspection or engineering evaluation.
  • May not reflect the current condition of any bridge or dam, as conditions can change between inspection cycles.
  • May contain errors, omissions, or outdated information from source datasets.

For official bridge condition information, load ratings, vertical clearance data, or safety concerns, contact your state Department of Transportation or the Federal Highway Administration directly.

BridgeStats is not affiliated with the Federal Highway Administration, the U.S. Department of Transportation, the U.S. Army Corps of Engineers, or any other government agency. We make no representations or warranties regarding the completeness, accuracy, or timeliness of any data presented on the Service.

6. Premium Subscriptions

6.1 Billing

Premium subscriptions are billed on a recurring basis (monthly or annually, depending on the plan selected). Payments are processed securely through Stripe. By subscribing, you authorize us to charge your selected payment method at the beginning of each billing cycle.

6.2 Price Changes

We reserve the right to adjust subscription pricing. Existing subscribers will be notified of price changes at least 30 days in advance. The new pricing will take effect at the start of your next billing cycle after the notice period.

6.3 Cancellation

You may cancel your premium subscription at any time. Upon cancellation, you will retain access to premium features until the end of your current billing period. No partial refunds are issued for unused time within a billing period.

6.4 Refunds

Refund requests are handled on a case-by-case basis. If you believe you have been charged in error or wish to request a refund, please contact us at [email protected] within 14 days of the charge. We reserve the right to grant or deny refund requests at our discretion.

7. Intellectual Property

7.1 Our Content

The BridgeStats name, logo, website design, original content, analysis methodology, grading algorithms, visualizations, reports, and software are the intellectual property of BridgeStats and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from our proprietary content without prior written permission.

7.2 Government Data

Underlying bridge and dam data from the NBI and NID is public domain information produced by the U.S. federal government. Our presentation, analysis, grading, and visualization of that data is our original work and is protected by copyright.

7.3 Permitted Use

You may use the Service for personal, educational, journalistic, and research purposes. Commercial use of our proprietary analysis, reports, or visualizations requires written permission. Automated scraping, crawling, or bulk downloading of data from the Service is prohibited without prior authorization.

8. Prohibited Conduct

When using the Service, you agree not to:

  • Violate any applicable law or regulation
  • Interfere with or disrupt the Service or its infrastructure
  • Attempt to gain unauthorized access to any part of the Service
  • Use automated bots, scrapers, or similar tools without authorization
  • Circumvent rate limits or access controls
  • Submit false or misleading information
  • Harass, abuse, or threaten other users
  • Use the Service to distribute malware or conduct phishing attacks
  • Reverse-engineer, decompile, or disassemble any part of the Service

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

IN NO EVENT SHALL BRIDGESTATS, ITS OWNERS, OPERATORS, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED U.S. DOLLARS ($100), WHICHEVER IS GREATER.

10. Indemnification

You agree to indemnify, defend, and hold harmless BridgeStats and its owners, operators, employees, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your User Content; or (d) your violation of any rights of a third party.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation between the parties.

If a dispute cannot be resolved through negotiation within 30 days, either party may pursue resolution through binding arbitration or the courts of competent jurisdiction.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, severed from these Terms. The remaining provisions shall continue in full force and effect.

13. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and BridgeStats regarding your use of the Service and supersede any prior agreements, communications, or understandings, whether oral or written.
